КоШиЯм — Terms of Service and End-User Licence

1. Acceptance of terms

The КоШиЯм mobile application and related services (the "App" or "Service") are operated via koshiyam.app by Peshets LTD, UIC/EIK [NUMBER], registered office [ADDRESS], Bulgaria, e-mail [SUPPORT E-MAIL], phone [PHONE] ("we", "us"). VAT number: [VAT NUMBER, if registered].

By downloading or using the App you agree to these terms and to the End-User Licence Agreement. If you do not agree, do not use the App.

2. What the Service does

КоШиЯм creates meal plans and grocery lists for a budget and timeframe you choose, using current prices and promotions of supermarkets near you (such as Lidl, Kaufland, BILLA, T Market, Fantastico, CBA and METRO). The Service:

• suggests menus and recipes generated with the help of artificial intelligence (AI);
• removes ingredients that contain the allergens and diet exclusions you declare, using an automated check that runs on every plan;
• prefers better-quality products (fewer additives, no imitation products) when your budget allows;
• estimates the cost of the grocery list and the savings from promotions.

3. No medical advice; health and allergy disclaimer

The App generates meal plans by automated data processing and artificial intelligence. The App is not a medical professional, nutritionist or dietitian.

• Allergies. You can declare allergies and diet restrictions, and every plan is checked against them. However, cross-contamination in factories, changed recipes and errors in supermarket data can occur. You are responsible for checking the physical ingredient label of every product before buying and eating it.
• Food safety. "Cook by" and expiry warnings are estimates based on typical shelf lives and promotional data. Follow the dates printed on the products and standard food-safety practice for storing and cooking perishable food.

The full Health & Allergy Disclaimer forms part of these terms. Our liability is limited as set out in section 10; that limitation does not exclude liability that cannot be excluded by law.

4. Data accuracy and third-party supermarkets

The App aggregates public price and promotion data from third-party retailers, including the official open data of the Commission for Consumer Protection ("Колко струва"). We do not guarantee the availability, exact price or quality of any item in your local store. The amount you pay at the till may differ; when fresh price data is unavailable for a store, the App shows "estimated prices".

КоШиЯм is not affiliated with, endorsed by or sponsored by Kaufland, Lidl, BILLA, METRO, T Market, Fantastico, CBA or any other retailer. Retailer names are used only to identify where products are sold.

5. Account

You may register with an e-mail address and password or with your Google account. You must be at least 16 years old (or have the consent of a parent or guardian) and give accurate information. Keep your login details secret. You can delete your account at any time in Settings → Delete account.

6. Free use and subscriptions

• Every new account can generate one free plan of up to 3 days.
• Unlimited plans require an auto-renewing КоШиЯм Premium subscription:

• 7-day free trial. If you have not had a trial before, your subscription starts with 7 days free. You enter a card at checkout, but it is first charged on day 8; cancel before then and you pay nothing. We remind you in the App 48 hours before the trial ends. There is one trial per person: a trial is linked to your account, your card and your device (we store only one-way hashes of the card fingerprint and of an app-specific device identifier). If the card or device has already been used for a trial, the subscription starts without a trial and the first period is charged straight away.
• Payments are processed securely by Stripe Payments Europe, Ltd. (Ireland). We never see or store your card number.
• The subscription renews automatically for the same period at the then-current price until you cancel. We will tell you about any price change at least 30 days in advance; you may cancel before it applies.

7. Cancellation and the 48-hour refund

1. 48-hour full refund. If you cancel within 48 hours of your initial purchase — the first payment actually charged, which after a free trial is the charge on day 8 — we refund that payment in full and premium access ends immediately. The refund is issued automatically when you cancel — in the App or in the Stripe billing portal.
2. After 48 hours you can still cancel at any time. We do not refund the current period; you keep premium access until the end of the billing cycle you have paid for, and the subscription does not renew. Renewal payments are not covered by the 48-hour refund.
3. Your statutory right of withdrawal is not affected. Under Art. 50 et seq. of the Bulgarian Consumer Protection Act (Directive 2011/83/EU) you may withdraw from the contract within 14 days of first subscribing without giving a reason. Because you ask us at checkout to start the Service immediately, a withdrawal after the 48-hour window but within those 14 days is refunded minus an amount proportionate to the paid days already provided (free trial days are not counted). 4. Refunds go to the original payment method; banks usually need 5–10 business days to show them.

8. Acceptable use and termination

You agree not to: use the Service unlawfully; access other users' data; reverse-engineer, decompile, scrape or overload the App or its AI infrastructure; extract or resell plans or price data; or create accounts by automated means.

We may suspend or terminate accounts that abuse the platform or breach these terms. Except where the law or security requires immediate action, we will tell you first and give you a chance to respond. If we terminate a paid subscription without a breach on your part, we refund the unused part of the period.

9. Intellectual property

The App is licensed, not sold, under the End-User Licence Agreement. Plans generated for you are yours to use for personal, non-commercial purposes.

10. Liability

Nothing in these terms limits liability that cannot be limited under Bulgarian law, including for intent, gross negligence, or death or personal injury caused by our fault. Otherwise our total liability for any claim is limited to the amounts you paid us in the 12 months before the claim. We are not liable for differences between estimated and actual prices, for products being unavailable, or for harm resulting from not checking product labels as described in section 3.

11. Changes

We may update the Service. We may change these terms for valid reasons (legal changes, new features, security) and will notify you at least 30 days before material changes take effect; you may cancel before they do.

12. Complaints, law and disputes

Contact us first at [SUPPORT E-MAIL]; we reply within 14 days. You may also turn to the Commission for Consumer Protection or the conciliation committees under the Consumer Protection Act. These terms are governed by Bulgarian law; the mandatory consumer protections of your EU country of residence still apply. Disputes go to the competent Bulgarian court, without prejudice to your right as a consumer to sue in your home courts.
